PumpedApp Terms of Use

Acceptance of Terms
By accessing or using the PumpedApp mobile application (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not access or use the App.  

Data Collection and Use
2.1 Data Collected

The App collects the following types of data:

Personal Information: This may include your name, email address, and any other information you provide when creating an account or using the App.  
Fitness Data: This includes weight, body measurements, workout information, and calorie intake, which you manually enter or sync from connected devices.
Usage Data: This includes information about how you interact with the App, such as features used, pages visited, and time spent on the App.
Device Information: This includes information about the device you use to access the App, such as device type, operating system, and unique device identifiers.
Location Data: With your permission, the App may collect and use your location data to provide location-based features and services.

We use the collected data for the following purposes:

Providing and Improving the App: To provide, maintain, and improve the App's functionality, features, and user experience.
Personalization: To personalize your experience with the App, including providing tailored content and recommendations.

Affiliates and Business Partners: We may share your data with our affiliates and business partners for marketing and promotional purposes.
2.4 International Data Transfers

Your data may be transferred to, stored, and processed in countries other than your own. By using the App, you consent to the transfer of your data to countries outside of your own, including countries that may have different data protection laws than your own.

User Responsibility
You are solely responsible for the accuracy and completeness of the data you enter into the App. You acknowledge that the App is not a substitute for professional medical advice and should not be relied upon as such. Consult with a healthcare professional before making any significant changes to your diet or exercise routine.

Social Features
If you choose to use the App's social features, you agree to:

Use the features in a respectful and appropriate manner.
Not post any content that is offensive, harmful, discriminatory, or violates the rights of others.
Not engage in any activity that could disrupt or interfere with the App's operation or other users' enjoyment of the App.
Third-Party Services
The App uses Google Firestore for data storage. By using the App, you acknowledge and agree to the transfer, storage, and processing of your data by Google Firestore in accordance with their privacy policy.

Intellectual Property
The App and its content, including but not limited to text, graphics, logos, images, and software, are the property of PumpedApp or its licensors and are protected by intellectual property laws. You may not use, reproduce, distribute, or modify any part of the App without our prior written consent.  

Disclaimer of Warranties
The App is provided "as is" without any warranties, express or implied. We do not guarantee that the App will be error-free, uninterrupted, or secure. We are not responsible for any damages arising from the use of the App.

Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use of the App.  

Termination
We reserve the right to terminate or suspend your access to the App at any time for any reason, without notice or liability.

Changes to Terms
We may update these Terms from time to time. Any changes will be posted within the App or notified to you via email. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

Governing Law and Jurisdiction
These Terms are governed by the laws of Israel. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Israel. For users outside of Israel, these Terms shall be governed by the laws of the user's country of residence, and any disputes shall be subject to the jurisdiction of the courts in the user's country of residence.
